Judge Tiffany Baker-Carper released Daniel Spencer on bond instead of locking him up to await sentencing. Spencer, 35, had already been convicted in an underage sex sting for trying to meet a 15-year-old girl. She left him on the street because he had been out of jail for a year without a violation and had no violent criminal history. About a month later, Spencer and the girl's mother, Chloe Spencer, beat and murdered his 5-year-old stepdaughter, Missy Mogle. Both were charged with second-degree murder in May 2025. That release was a miscarriage of justice and a dereliction of judicial duty. Gov. Ron DeSantis said so, told the Florida House it has the votes to impeach Baker-Carper, and warned that judges will keep finding ways to benefit the criminal element until they are held accountable. The same day, he signed Missy's Law, which orders judges to keep defendants convicted of dangerous crimes in custody instead of freeing them before sentencing. He said Missy would be alive if that law had been in place.
